PRESENTATION ON THE REGISTRATION OF BUSINESS NAMES ACT, 2018 AND THE REGISTRATION OF BUSINESS NAMES RE-REGISTRATION ACT, 2018

Stella Kiggundu presented on the Registration of Business Names Act, 2018 and the Registration of Business Names Re-registration Act, 2018. (Both Acts have not yet commenced).

 
The purpose of the Registration of Business Names Act is to provide for the registration of firms, individuals and bodies corporate carrying on business under a business name. (a “business name” means the name, title, description or style under which any business is carried on, whether in partnership or otherwise. In comparison to the old Act of 2008, the new Act significantly increases the penalties for non-compliance with the provisions of the Act. The new Act further allows for both the restoration of a business name which has been removed from the register as well as for its renewal prior to expiry.

 
The purpose of the Registration of Business Names Re-registration Act is to provide for the re-registration of existing business names under the Registration of Business Names Act. It is important to note that upon commencement of the Act, all applications to re-register an existing business name must be made within 12 months. Failure to do so will result in de-registration and removal of the business name from the register.
